Article 1: object
These General Terms and Conditions of Sale determine the rights and obligations of the parties in connection with the online sale of Products offered by the Seller.
Article 2: General provisions
These General Terms and Conditions of Sale apply to all sales of Products made through the Company's website which are an integral part of the Contract between the Buyer and the Seller. The Seller reserves the right to modify these at any time by publishing a new version on its website. The applicable T&Cs are those in force on the date of payment of the order. The Customer declares to have read all of these T&Cs, and to accept them without restriction or reservation.
Article 3: Price
The prices of the products sold through the website are indicated in Euros excluding and including tax and precisely determined on the product description pages (excluding shipping costs).
Packaging, order processing and shipping costs are indicated before validation of the order.
For all products shipped outside the European Union and/or DOM-TOM, customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These rights and sums are not the responsibility of the Seller. They will be the responsibility of the Buyer and reveal his responsibility. The Seller therefore invites the buyer to inquire about these aspects with the corresponding local authorities. The Company reserves the right to modify its prices at any time for the future.
Article 3: Terms of Order
The Customer will have to follow a series of steps to be able to place his order: - Information on the essential characteristics of the Product; - Choice of the Product and its options and indication of the Customer's essential data (Identification, address, etc.); - Acceptance of these T&Cs; - Verification of the elements of the order; - Payment instruction and payment for products. The Customer will then receive confirmation by e-mail of the payment and confirmation of the order. Delivery will be made to the address indicated by the Customer. For the purposes of proper execution of the order, the Customer undertakes to provide his true identification elements.
The Seller cannot be held responsible if erroneous information is given by the Customer resulting in the non-performance of the service covered by these GCS. The Seller reserves the right to refuse the order, for example for any abnormal request, made in bad faith or for any legitimate reason.
Section 5: Products
The essential characteristics of the Products and their respective prices are made available to the buyer on the website. The Customer certifies with receipt the details of the delivery costs as well as the terms of payment, delivery and execution of the order. The Seller undertakes to honor the Customer's order within the limit of available Product stocks. Otherwise, the Seller must inform the Customer. The parties agree that the descriptions and photos of the products offered for sale have no contractual value. We are committed to ensuring that they are as close as possible to reality, and remember that colors and dimensions can be modified by the screens used.
Unless otherwise specified, the rights granted hereunder are granted only to the natural person signing the order (or the person holding the email address communicated). In accordance with the legal provisions in terms of conformity and hidden defects, the Seller undertakes to reimburse or exchange defective products or products that do not correspond to the order.
Article 6: Retention of title clause
The Products remain the property of the company until full payment of the price.
Article 7: Method of delivery
The products are delivered to the delivery address that was indicated when placing the order. The Seller cannot be held responsible if erroneous information is given by the Customer resulting in the non-performance of the service covered by these GCS. The delivery times indicated on the site are an estimate for information only.
Orders are delivered by the French Post Office, depending on the different options presented during the validation of the order (sending green letter, sending with tracking, etc.) and chosen by the Customer. Under no circumstances can the Seller be held responsible for late delivery by the carrier. However, he is required to do everything possible to ensure that the package is delivered in good condition.
Products are delivered worldwide.
The Seller reminds that when the Customer takes physical possession of the products, the risk of loss or damage to the products is transferred to him. It is up to the Customer to notify the carrier of any reservations about the product delivered.
Article 8: Availability and presentation
Orders will be processed within the limits of our available stocks. In the event of the unavailability of an article, you will be immediately informed of the foreseeable delivery times and the order for this article may be canceled on simple request. The Customer may then request a credit note or a refund.
Article 9: Payment
Payment is due immediately upon ordering, including for pre-order products. The Customer can pay by credit card with our secure online payment partners Paypal and Stripe. Each connection to our site is secure (you can see it as soon as the address changes and starts with https://www...). The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or the impossibility of debiting the card, the Sale is immediately resolved as of right and the order is cancelled.
Article 10: Deadline and right of withdrawal
In accordance with Article L. 121-20 of the Consumer Code, the consumer has a period of 14 clear days to exercise his right of withdrawal without having to justify reasons or pay penalties with the exception, the if applicable, return costs. The period mentioned in the previous paragraph runs from receipt for the goods (the postal stamp on the envelope being taken as proof). In the event of exercise of the right of withdrawal within the aforementioned period, only the price of the product(s) purchased will be refunded, the return costs remain the responsibility of the Customer. Returns of products must be made in their original state (unworn) and complete (packaging, etc.) so that they can be resold in new condition.
The shipping costs related to the return of the products remain the responsibility of the customer unless the product received is not in conformity or has a manufacturing defect.
Any customs fees related to the return of a product from a foreign country are also the responsibility of the customer.
Upon receipt, and subject to these return conditions, the Seller agrees to refund the order excluding initial shipping costs to the customer's bank account (same card used for payment) within 15 days of receipt of the package by the Seller.
Article 11: Warranties
In accordance with the law, the Seller assumes two guarantees: of conformity and relating to the hidden defects of the products. The Seller reimburses the buyer or exchanges the products which are apparently defective or which do not correspond to the order placed. Article 12: Intellectual property rights
Trademarks, domain names, products, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the Seller. No assignment of intellectual property rights is made through these T&Cs. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.
Article 13: Force majeure
The performance of the Seller's obligations hereunder is suspended in the event of the occurrence of a fortuitous event or force majeure which would prevent its performance. The Seller will notify the customer of the occurrence of such an event as soon as possible.
Article 14: Protection of personal data
In accordance with the Data Protection Act of January 6, 1978, you have the right to query, access, modify, oppose and rectify personal data concerning you. By adhering to these general conditions of sale, you consent to our collection and use of this data for the performance of this contract. Article 15: Applicable law
